Agreement on Establishment of Bosnia and Herzegovina Public Corporations
Annex 9 is the Agreement on Establishment of Bosnia and Herzegovina Public Corporations. The parties are the Federation of Bosnia and Herzegovina and the Republika Srpska.
Summary of Main Points
The parties agree to establish a five-member CPC to facilitate operating joint public facilities for operating utilities, energy, postal, and communication facilities for the benefit of both entities.
The President of the European Bank for Reconstruction and Development will appoint two members and designate one to act as Chairman of the CPC. The other members will include two individuals from the Federation of Bosnia and Herzegovina and one from the Republika Srpska.
The parties agree to form a Transportation Corporation headquartered in Sarajevo to operate roads, railways, and ports. The CPC will choose the Transportation Corporation's Board of Directors, who will in turn select the officers and staff. These bodies will be generally representative of Bosnia and Herzegovina's three ethnic groups.
The CPC may recommend the establishment of other Public Corporations.
Upon the Agreement Entering Into Force
- Parties establish a CPC and a Transportation Corporation.
Within 15 Days (29 December)
- The Federation of Bosnia and Herzegovina appoints two members and the Republika Srpska appoints one member to the CPC. The parties meet to determine which facilities the Transportation Corporation will operate.
Within 30 Days (13 January)
- Parties agree to the sums of money to be contributed to the Transportation Corporation.
