Agreement on Commission To Preserve National Monuments
Annex 8 is the Agreement on the Commission to Preserve National Monuments. The parties are the Republic of Bosnia and Herzegovina, the Federation of Bosnia and Herzegovina, and the Republika Srpska.
Summary of Main Points
The parties agree to establish an independent CPNM with headquarters in Sarajevo to designate property as having cultural, historic, religious, or ethnic importance as national monuments.
The Director General of the UN Educational, Scientific, and Cultural Organization will appoint two members and designate one to act as Chairman, CPNM. The other members will include two individuals from the Federation of Bosnia and Herzegovina and one from the Republika Srpska.
No one who has been sentenced by the International Tribunal for the Former Yugoslavia or who is under indictment and has failed to appear before the Tribunal may serve on the CPNM.
Any party or person in Bosnia and Herzegovina may petition the CPNM to designate property as a national monument. For 1 year after receiving a petition or until a decision is rendered, all parties will refrain from damaging the property. The CPNM decisions are based on a majority vote. Following a decision, the entity in whose territory the property is situated shall make every effort to protect, conserve, present, and rehabilitate the property and refrain from damaging it.
Upon the Agreement Entering Into Force
- Parties establish a CPNM.
Within 90 Days (13 March)
- The Federation of Bosnia and Herzegovina appoints two members and the Republika Srpska appoints one member to the CPNM.
After 5 Years
- With the agreement of the parties, the CPNM transfers to the institutions of Bosnia and Herzegovina, or otherwise continues to operate as before.
