AIR FORCE FREEDOM OF INFORMATION ACT PROGRAM
NOTE: AFI 37-131, 16 February 1995, is supplemented as follows: This supplement applies to HQ Air Intelligence Agency (AIA) directorates, major staff offices, and AIA-subordinate units. It does not apply to AIA-gained Air National Guard or Air Force Reserve units. Subordinate units must send one copy of each supplement to the Agency Records Management Branch (HQ AIA/IMQ), 102 Hall Blvd, Ste 123, San Antonio TX 78243-7039.SUMMARY OF REVISIONSThis supplement clarifies the responsibilities of the records management functions in relation to Freedom of Information Act (FOIA) processing; designates the AIA FOIA disclosure and denial authorities; places the FOIA program into the unit records management function; adds the requirement to designate unit FOIA managers and unit functional FOIA monitors; identifies routinely deployable and sensitive units; changes the host-tenant processing procedures; and updates office symbols.2.4. The Chief, Office of Information Management (HQ AIA/IM) ensures that AIA complies with the FOIA Program. HQ AIA/IMQ is designated the Agency FOIA Manager and manages the FOIA Program. Each AIA unit records management function manages the unit FOIA program. The unit commander must appoint the unit FOIA manager by letter, and forward the name, rank, grade, office symbol, and telephone number to HQ AIA/IMQ. A unit FOIA manager may appoint FOIA monitors for functional areas within the unit.
2.5.1. (Added) FOIA monitors:
Are the focal point in their functional area.
Answer general FOIA questions.
Act as liaisons between the unit FOIA managers and offices of primary responsibility (OPR). 2.7. Within AIA, the authority to determine disclosure of records to the public is delegated to: Headquarters Air Intelligence Agency, Commander (HQ AIA/CC); Vice Commander (HQ AIA/CV); HQ AIA/IM; the Director of Civilian Personnel (HQ AIA/DPC); the National Air Intelligence Center, Commander (NAIC/CC), and the Vice Commander (NAIC/CV); the 497th Intelligence Group, Commander (497 IG/CC); and the Director of HUMINT (497 IG/INH).
2.7.1. (Added) All subordinate units (except San Antonio-area units) send FOIA request packages for processing to the appropriate FOIA office having disclosure authority (as identified in paragraph 2.7). Include in the request package: the request, requested documents, and the unit commander's release and denial recommendation. Unit FOIA managers (except San Antonio-area units) will notify the requester that their request was received and forwarded to the appropriate release and denial authority under FOIA.
4.2. (Added) The COR (chiefs of offices of record) who receive from the public written FOIA requests for records that cites or implies the FOIA, will immediately handcarry the requests to their local FOIA manager or monitor for processing.
10.6.3. All units within AIA are identified and qualified for the exemption according to paragraph 10.6.2.12. HQ AIA/IM, NAIC/CC, and the 497 IG/CC are the appointed additional denial authorities under the FOIA
13.1.1. (Added) FOIA managers at the 497 IG and NAIC send annual FOIA reports on 3 1/2- or 5 1/4-inch disk with a printed copy to HQ AIA/IMQ to arrive not later than 4 January of each year. Do not put classified information into the FOIA system.14. Within AIA, all FOIA requests are handled by the designated AIA FOIA managers.
