1. Purpose. To prescribe procedures to implement the Navy Drug-Free Workplace Program.

3. Background. The basic requirements for a Federal drug-free workplace were established by
Executive Order 12564 and Public Law 100-71 and implemented in the Navy by references (a)
through (c). Within the Chief of Naval Operations, the DFWP will be standardized to the
greatest degree possible by following guidance in reference (c).
4. Who is subject to testing. Testing-designated positions (TDPs) for the whole command are
listed in enclosure (1). Incumbents of these positions are subject to "reasonable suspicion" and
"accident/unsafe practice" testing. All employees receive general notice of the DFWP, while
those in TDP's receive individual notice from the command 30 days prior to being subject to
unannounced random testing.
5. Procedures
a. Drug Program Coordinator (DPC) services must be provided by the local host air activity
(or other federal activity, if necessary) through a servicing agreement. See "Action" below.
b. Voluntary testing. Employees not identified by other means as subject to testing under this
program may volunteer to be included in the program by submitting a written request to the
activity Drug Program Coordinator (DPC). A written acknowledgment as prescribed in
Appendix G of reference (c) will be returned to such voluntary applicants.
c. Reasonable suspicion or accident/unsafe practice testing. RIPOs and RIACs are authorized to request such testing in accordance with Chapter IV of reference (c). Such requests must be approved by the Deputy Commander or his/her designees. The threshold for determining whether accident or unsafe practice testing is required will be based on Class C mishap criteria as defined in reference (d).
d. Applicant testing. Individuals tentatively selected for positions identified as TDPs who test
positive for illegal drugs will be barred from placement consideration of any kind for positions at
any CNO command or activity for a period of six months from the date of the positive drug test.
Records of positive results will be maintained by the local DPC but will be reported to the Dallas
Field Office, Human Resources Office New Orleans. That office will coordinate
employment/placement offers with the local DPC and obtain authorization prior to making a
final offer of employment.
e. Follow-up testing. All employees referred through administrative action to counseling or
rehabilitation through the Civilian Employee Assistance Program for illegal drug use will be
subject to follow-up testing. This testing is separate from the regular random testing. The length
of time the employee is subject to follow-up testing and the frequency of the test will be
determined on a case by case basis.
6. Action. All RIACs having civilian employees shall:
a. Negotiate and execute a DPC servicing agreement between the RIA and the local host air
activity (or other federal activity, if necessary). A sample agreement is at appendix A of
reference (c). Provide a copy of the executed agreement to headquarters.
b. Inform headquarters when civilian employees are tested.
c. Recommend changes to the TDP listing (enclosure (1)) as necessary.
